First: Great commentary with lots of good arguments! :)

However, your outline of the copyright holders' missing SWOT analysis is as sloppy as the analysis you are accusing them of not having done: When you are holding up Pirate Bay's Strengths and Weaknesses in the same SWOT as the copyright holders' Opportunities and Threats, it's like comparing apples and apple-eating caterpillars. ;)

This is picky, I know, but such accusations should be valid.

Regarding your second point, it's important to see this from both sides. While the entertainment market is global, the advertizing market isn't for the most part. There are a lot of things to work out regarding web streaming and revenue, and to be fair it's not easy to scale this globally. I really hope it can be done, because that's the way it's going regardless of earnings, but it's not a simple issue.

"The internet is 20+ years, how long is it going to take?"

I like this qoute. It´s like I can see mr Solstad as his frustration grows as the article gets longer. It´s the question that you know has no answer. Still, it has to come out.

Just a note: it's *perfectly legal* to download copyrighted work from P2P networks in many countries (i.e. Spain) as long as you keep the copy for your personal use and don't download SW that needs a license.

Some issues are missing in your excellent post.

1 - The record industry all about making the quick buck. When disco hit in the 70s they flooded the marked with crappy music. This resulted in the I HATE DISCO revolt in the late 70s. Most of them have the same business plan today, find a hit and flood the marked. Then the hit radios with heavy rotation kills the hits and you don't bother to pay for music you no longer can stand, even if it's good. For the record I'm one horrible r&b song from starting a revolt against anything that sounds like Justin Timberlake.

2 - The marked is global, if tv-stations sends popular tv series the same day globally and offer some kind of webtv either with commercials or as an subscription so you can pick up the shows the next day there will be no need to steal content. Look at NRK in Norway, it is hard to find ripped tv shows from NRK. The only show I see on trackers are "Nytt på nytt" but then again it was not offered in a web version until recently and I guess the release is a old habit. It is also getting harder and harder to find BBC programing on trackers, I would guess the Iplayer had something to do with that...

3 - It is time to listen to the marked again, it looks like the record industry never learned that.. In the 90s i just wanted a good song I liked, I either had to pay 50 NOK for a crappy CD singles with bad remixes and the song you liked, the whole CD or a mixed CD where you hated 80% of the songs. Then I just wanted a MP3 with decent quality and no DRM. The record industry gave us DRM and even started putting rootkits on CDs, oh yea.. and the songs on Itunes were in horrible quality.. Now days I can get a MP3 without DRM in good quality, it is just to bad I'm looking for flac files.

Stop expecting amazing sales again, it is easy to take a backup of a CD, I will never by the same CD 3-4 times again. If I have a wild party I just make copy's of the CD's or just play songs from a Ipod. It is legal to copy music and give to friends in Norway, expect that we will do that, just as we made tapes from records in the 80s. But I no longer make a mixed CDs, I no longer send files over Instant messenger I send a Youtube link or the shared playlist of a streaming service. To bad you constantly get; "this video is not available in your area" and that good streaming services have to remove content. It should not be a huge issue that Itunes sells the Beatles. it should be a shame that they was not allowed to do that..

My advice: Stop using money on what most be bad legal strategies, budget in that you will loose money the next year or two while you make sure it is easy to stream music and you figure out what the customers expect in quality and in price. Teenagers will pay more to annoy me on on a buss with a horrible ringtone than for the actual song on itunes. But then again, it has always been easy to to get a ringtone, just text badsong to 2200 and you can use it. Not download it to your computer, be pissed about DRM, hate Itunes because it is slow(and delete stuff when you don't want it to) and then be able to listen
- Start thinking and -start listening to your customers!
